Florida's data center rules are being rewritten — right now.
Four bills are moving through Florida's 2026 legislative session that would, for the first time, create a statewide framework for regulating hyperscale data centers. Until these pass, most decisions still rest with county and city commissions — the level of government where most residents learn about a project only days before a vote.
The bills differ significantly in what they require. SB 484 preserves local control and prohibits utilities from shifting data center infrastructure costs onto residential ratepayers. HB 1007 is more restrictive, explicitly permitting counties to ban hyperscale data centers without weighing economic benefits. SB 1118 goes the other direction, creating public-records exemptions that would let developers keep project details confidential for up to 12 months. All are subject to change as they move through committee.
